Supreme Court Dismissed PDP’s Suit Against APC

Supreme Court dismissed the PDP’s suit against APC Vice President-Elect Kashim Shettima’s eligibility to contest the Presidential election held on February 25, 2023. The court says that the appellant failed to show documentary evidence that SHIttima was a candidate for double nomination. According to PDP’s suit, the manner the APC Bola Ahmed Tinubu nominated Kashim Shettima as Vice Presidential candidate for the election was a gross breach of the provision of the Electoral Act. The party had argued that there was evidence to establish that Shettima had the double nomination. Both for the Vice Presidential Position as well as the Borno Central Senatorial seat. An action the PDP maintained was contrary to the law. The Supreme Court’s judgement:

  • The issue of locus is important.
  • A Plaintiff’s locus is linked with the court’s jurisdiction
  • A plaintiff must show harm or substantial harm is done to him by the action he is complaining about
  • The appellant relied greatly on section 248(14C) of the Constitution
  • This section deprived the appellant of the locus as its bars interference of political parties into the affairs of other political parties.

According to Defendant, Shettima did the needful by withdrawing the nomination of candidature for the Senate before accepting the nomination for the Vice President.

The Supreme Court dismissed the suit, and a cost of 2 million Naira was awarded against the plaintiff.
