Lagos State Tribunal Dismissed GRV’s Application

Lagos State Tribunal dismissed the candidate of the Labour Party, Gbadebo Rhodes-Vivour (GRV), who was seeking an order for leave to consolidate his petition with that of the Peoples Democratic Party (PDP) and his candidate, Olajide Adediran. The Lagos State Tribunal also dismissed GRV’s request to file an additional list of witnesses.

The dismissal is on the grounds that the petitions, facts, and subject matters are different. The LP candidate brought petition against the INEC, Governor Babajide Sanwo-Olu and his deputy Obafemi Hamzat. INEC declared Sanwo-Olu and Hamzat the winners of the March 18, 2023 election and their party, the APC. But in Olajide Adediran’s petition, he and his party, the PDP, are the petitioners, while the respondents are INEC, Mr Sanwo-Olu and Hamzat, the APC, and Mr Rhodes-Vivour and his party. In the second application, which was dismissed, the Tribunal held that the LP’s candidate should have sought the leave of the court for an extension of time within which to amend his petition, as the 21 days stipulated by the Electoral Act within which to file an election petition has passed.
