The Abuja-based Court of Appeal has scheduled a review on March 8, 2023, to consider the Independent National Electoral Commission’s (INEC) request to reconfigure the Bimodal Voter Accreditation System (BVAS) used in the February 25 presidential election.
The three-member panel postponed a decision on physically inspecting all BVAS units used in the election.
Onyechi Ikpeazu (SAN), representing Peter Obi and the Labour Party, argued that the application was necessary to extract data embedded in the BVAS, meaning the actual results from polling units. INEC’s lead counsel, Tanimu Inuwa, opposed the request, citing possible disruptions to preparations for the Governorship and National Assembly elections scheduled for March 11, 2023.
Following the hearing, Justice Joseph Ikyegh-led panel adjourned the ruling on the issue until March 8, 2023.
