Apex Court Has Not Concluded on Naira Swap Policy, Says Ozekhome

A Senior Advocate of Nigeria, Mike Ozekhome, said Supreme Court has not yet decided on the issue of the Naira Swap Policy that states 10 February as a deadline for old N200, N500 and N1000 banknotes. This statement comes after Justice John Okoro, who led a seven-man panel at the apex courts, granted an interim injunction halting the policy’s implementation.

Indeed, the development was a relief for most Nigerians who have been facing challenges accessing new naira notes.

The SAN, who appeared on Channels TV on Wednesday night, cleared the air that the judgement was not a conclusive stance on the Naira Notes swap policy. All that the Supreme court has done is fall back to a decision like Kotoye v. CBN, that in matters of extreme urgency, a grant an interim order is needed, even if it be ex parte, to prevent truncating the subject matter.

The Supreme court judgment is another saying, “Let us first drive the fox before we blame the fowl for wandering too far into the forest.”
